Following the earthquake in Kahramanmaras, new settlement and construction decisions were made in the provinces where a state of emergency was declared.

The Decree of the President, published under the heading “Settlement and Construction under the State of Emergency” in today’s issue of the Official Gazette, includes various decrees.

According to the decree, areas of temporary and final resettlement affected by a natural disaster can be determined ex officio by the Ministry of Environment, Urbanization and Climate Change.
The qualification of land allocated to the General Forestry Department that is not actually covered by forest will be changed and registered in the name of the Treasury. State lands, provided that they are at least twice as high as the changed areas, will be allocated to the Main Forestry Department for the creation of forests. Excluded from control places in the earthquake zone will also be registered with the Treasury.

Lease agreements and mining licenses for recreational areas, forest parks and real estate leased in places of temporary and final settlement will be considered canceled ex officio. The decision on the transfer and urgent alienation can be made in respect of immovable property owned by state institutions and organizations, as well as in relation to all immovable property that is in private ownership.

Stamp duty, duties, fees and expenses will not be charged on plans, plots, building permits, real estate transfers or zoning rights, clearing and barter transactions and files prepared in connection with these transactions.

Expropriation procedures will be handled by the Ministry of Environment, Urbanization and Climate Change or the Housing Authority (TOKİ). Domestic or foreign persons, institutions and organizations will be able to build residential buildings and workplaces in places designated by the Ministry. Demolition waste will be dumped at locations designated by the Governor.

As a result of the earthquakes that occurred on February 6 in Turkey and claimed the lives of more than 43 thousand people, more than 160 thousand buildings were destroyed or seriously damaged, including 520 thousand apartments.

President Tayyip Erdogan promised that the houses would be restored within a year.
